Xiaomi Home Cloud Storage User Agreement

Xiaomi Inc. (hereinafter referred to as "Xiaomi", "we", "our", or "us") hereby reminds users to carefully read and fully understand this User Agreement (hereinafter referred to as the "Agreement"). Please carefully read and fully understand all the terms and conditions of this Agreement, especially those regarding governing laws, dispute resolution, and the exemption of Xiaomi from liabilities or limits to its liabilities. The clauses regarding the limitation and exemption of liability are presented in bold font for your convenience. Please pay special attention to them while reading. Please decide whether to accept this Agreement after reading it. Minors shall read this Agreement accompanied by a legal guardian. Your use of Xiaomi Home cloud storage services constitutes acknowledgement that you have read and fully understood this Agreement and consent to be bound by and accept its terms and conditions. If you do not agree to this Agreement or any of its terms and conditions, you should not use cloud storage services. If you do not agree to this Agreement or any of its terms and conditions, you should not use cloud storage services. Xiaomi has the right to modify this Agreement. Notification regarding the updated terms will be provided on the Xiaomi Home cloud storage website and will come info effect on the date specified in the revised Agreement.

1. General provisions

1.1 Xiaomi Home's cloud storage service is a neutral information storage space provided by Xiaomi for smart camera users. It uses cloud storage technology to provide users with online services such as data storage, synchronization, and management for smart cameras. You understand that Xiaomi only provides storage services to users and is a neutral technical service provider.

1.2 The types, service standards, and billing standards of Xiaomi Home cloud storage services are subject to those described in the Xiaomi Home camera cloud storage interface and related instructions when purchasing specific services, unless otherwise described in this Agreement or agreed upon by both parties.

1.3 This Agreement is a binding agreement between you (hereinafter referred to as the "User"), and Xiaomi and its affiliates and operational cooperators (hereinafter referred to as "Cooperators") with respect to the use of Xiaomi Home cloud storage services.

2. Creating accounts and signing in

2.1 The User needs to create a Xiaomi Account to be able to use Xiaomi Home cloud storage services. In creating and using the Xiaomi Account, the User must abide by the Xiaomi Account Privacy Policy (https://account.xiaomi.com/about/protocol/agreement?_locale=en_US ).

2.2 Xiaomi Account is used as the basis for user identification when using Xiaomi Home cloud storage services. Keep your Xiaomi Account and its password safe. If any dispute arises regarding your Xiaomi Account or behaviors associated with it, you will bear full responsibility.

3. Service fees

3.1 When the User subscribes to and/or uses Xiaomi Home cloud storage services, they shall pay the corresponding fees to Xiaomi. The User may select a subscription package according to their own needs. The subscription price shall be subject to the price officially announced by Xiaomi.

3.2 Users can purchase services directly via the Xiaomi Home app. Users must understand that cloud storage services are virtual products and no refunds are supported after a completed purchase.

3.3 Xiaomi only issues invoices to Xiaomi Home cloud storage users and does not issue invoices to any third party. If you require an invoice, call Xiaomi's service hotline at 400-100-5678.

3.3.1 Submit an invoice application and corresponding materials in accordance with Xiaomi Home cloud storage rules, including but not limited to screenshots of subscription renewals, invoice header name, and invoice amount.Xiaomi will issue a VAT invoice for the corresponding amount and send it within 30 days of receiving the application.Once the invoice is sent to the mailing address filled in by the User, Xiaomi is deemed to have fulfilled its obligation to issue the invoice.

3.3.2 Invoices cannot be re-issued. Users are solely responsible for any errors in invoice header, mailing address, and other information caused by submitting incorrect materials.

3.4 Once your Xiaomi Home cloud storage plan expires, the service will be terminated. This will affect your use of this service.If you wish to continue using this service, purchase a new subscription package.

4. Terms of service

4.1 The cloud storage purchase page can be reached by tapping "Cloud storage" on the bottom of the camera's live video page.When your cloud storage subscription expires, go to the cloud storage page and tap Manage > Renew to purchase a new subscription.

4.2 This service takes effect as soon as it is purchased.The duration of your cloud storage service is calculated based on the start and end dates shown when you purchase the package of your choosing. If you are not currently using cloud storage services, or if you previously purchased a package that has expired, the duration of your service will be calculated from the date of your most recent purchase.For example, if you purchase an annual cloud storage plan at 11:30 on June 5, 2018, the service will start at 11:30 on June 5, 2018, and the service will end at 11:30 on June 5, 2019. If you have a currently active cloud storage package, the renewal time will be calculated from the end of your currently active subscription. For example, if your current cloud storage plan expires at 11:30 on June 5, 2019, the purchased renewal plan will become active at 11:30 on June 5, 2019. If you have a currently active cloud storage package, the renewal time will be calculated from the end of your currently active subscription. For example, if your current cloud storage plan expires at 11:30 on June 5, 2019, the purchased renewal plan will become active at 11:30 on June 5, 2019. If you have an active cloud storage plan when purchasing an AI cloud storage plan, the basic cloud storage plan will be suspended for the duration of AI cloud storage plan, after which it will reactivate.For example, if you have an active basic cloud storage plan with 10 days remaining, and purchase an annual subscription for an AI cloud storage plan at 11:30 on October 1, 2025, the basic plan will be suspended at 11:30 on October 1, 2025. When the AI cloud storage plan expires at 11:30 on October 1, 2026, the remaining 10 days of the basic plan will be reactivated until it expires at 11:30 on October 11, 2026.

4.3 Once the service takes effect, video will be recorded and uploaded to the cloud as soon as movement is detected. Please note that when the camera enters sleep mode, video will cease to be uploaded to the cloud. Once the service expires, no new video will be uploaded to the cloud. Videos already saved to the cloud will be deleted on a rolling basis. Please note that when the camera enters sleep mode, video will cease to be uploaded to the cloud. For example, if you purchased a 7-day rolling storage package that has just expired today, your videos from 7 days ago will be deleted tomorrow, your videos from 6 days ago will be deleted the day after tomorrow, and so forth. Within 7 days following the day of your package's expiration, all your videos will have been deleted from the cloud.

4.4 When using cloud storage services, you can tap "Manage" on the cloud storage viewing page to find the video upload switch.If you turn this feature off, videos will no longer be uploaded to the cloud. View your videos on the cloud storage page and tap Download or Delete accordingly.

4.5 You agree that purchased subscriptions cannot be changed. If you wish to change the subscription, wait for the current subscription to expire, then purchase a new one.

4.6 Cloud storage services connect the device with your Xiaomi Account. If you remove the device from the current account and add it to a new account, you won't be able to use the purchased subscription anymore.For example, if user A purchases a cloud storage subscription and subsequently removes the device from their account, user B will not be able to view user A's videos in the cloud, even if user B adds the same device to their account. 4.7 Video will be affected by your network conditions when it is uploaded to the cloud. When your network connection is good, video will upload to the cloud in the camera's highest resolution by default. If the network connection is poor, we'll temporarily reduce the resolution in order to try to ensure the integrity of the uploaded video. 5. Terms of use

5.1 The User is entitled to use Xiaomi Home cloud storage services in accordance with this Agreement, but in accordance with both this Agreement and the law, the User may do none of the following:

5.1.1 Delete any copyright information from Xiaomi Home cloud storage services and other copies thereof; amend, delete, or evade any technical measure set for protecting intellectual property rights;

5.1.2 Conduct any reverse engineering of Xiaomi Home cloud storage services, such as disassembly, decompilation, or any other action aimed at obtaining the source code of cloud storage services;

5.1.3 Modify or forge parts of Xiaomi Home cloud storage services such as commands or data; add, delete, or change the features or operating effects of cloud storage services; use any software or methods for the purposes described above in order to operate Xiaomi Home cloud storage services or transfer them to the public, whether or not such acts are for commercial purposes;

5.1.4 Use Xiaomi Home cloud storage services to undermine network security, including but not limited to the use of unauthorized data or access to unauthorized servers/accounts; delete, modify, or add storage information in public networks or other people's operating systems without permission; probe, scan, or test the weaknesses of the cloud storage system or network or undertake other actions that might disrupt network security; try to interfere with or destroy the normal operation of cloud storage systems or websites; deliberately spread malware or viruses or cause other damage to network security; or forge TCP/IP names fully or in part;

5.1.5 Sign in to or use Xiaomi Home cloud storage services through any third-party compatible software or system not developed, authorized, or recognized by Xiaomi, or produce, publish, or disseminate the aforementioned tools;

5.1.6 Without the written consent of Xiaomi, conduct any of the following behaviors to Xiaomi Home cloud storage services and the information in it, including but not limited to using, leasing, lending, copying, amending, linking, reprinting, compiling, and publishing, establishing a mirror website, and arbitrarily developing any relevant derivative products, works, services, plug-ins, tag-ons, compatibility or interconnection by virtue of cloud storage services;

5.1.7 Use Xiaomi Home cloud storage services to publish, transmit, spread, and store content that violates your local laws. If you are a User on the mainland of the People's Republic of China, you may not use cloud storage services to publish, transmit, spread, and store content that violates national laws; endangers national security, national unity, social stability, public order, and good morals; or contains any improper, insulting, obscene, or violent content, or violates national laws, regulations and policies;

5.1.8 Use Xiaomi Home cloud storage services to publish, release, transmit, spread, or store content that infringes upon the rights of others, such as intellectual property rights, trade secrets, and other legal rights;

5.1.9 Use cloud storage services to publish, transmit, or spread advertising information and spam in batches;

5.1.10 Other use of cloud storage services or other services provided by Xiaomi in any illegal manner, for any illegal purpose, or in any manner inconsistent with the use of this Agreement.

5.2 Rules regarding information publication

5.2.1 With regard to the content published via Xiaomi Home cloud storage services, the User shall guarantee that they have the intellectual property rights for the uploaded content or have obtained legal authorization, and the use of cloud storage services by the User does not infringe upon legitimate rights and interests of any third party.

5.2.2 You are required to abide by local laws and regulations when using Xiaomi Home cloud storage services. If you are a user on the mainland of the People's Republic of China, you should abide by the 'seven base lines' of Chinese laws and regulations, the socialist system, national interests, legitimate rights and interests of citizens, social public order, morality, and authenticity of information.

5.2.3 You may not use Xiaomi Home cloud storage services to perform the following actions, including but not limited to:

5.2.3.1 Producing, reproducing, publishing, spreading, and storing content that violates local national laws and regulations. If you are a user on the mainland of the People's Republic of China, this includes engaging in behavior that (1-11):

1) Violates the basic principles of the constitution;

2) Endangers national security, discloses state secrets, subverts state political authority, or threatens national unity;

3) Damages national honor and interests;

4) Incites racial hatred or discrimination, or harms national unity;

5) Violates national religious policy or advocates cults and superstitions;

6) Spreads rumors, disrupts social order, or damages social stability;

7) Encourages obscenity, pornography, gambling, violence, murder, terrorism, or instigates any crime;

8) Insults, slanders, or infringes on the legal rights of other people;

9) Incites illegal assemblies, associations, processions, demonstrations, and gatherings to disrupt social order;

10) Acts in the name of an illegal civil organization;

11) Violates laws and administrative regulations in any other way.

5.2.3.2 Releasing, transmitting, spreading, or storing content that infringes upon the rights of others, such as the rights of reputation, portraiture, intellectual property, trade secrets, and other legal rights.

5.2.3.3 Spreading false information or concealing the truth for the purpose of misleading or deceiving others.

5.2.3.4 Using cloud storage services to publish, spread, or promote advertisements and spam.

5.2.3.5 Engaging in other violations of local laws and regulations.

5.2.4 The User may not carry out any commercial conduct using Xiaomi Home cloud storage services without written authorization from Xiaomi, including but not limited to advertising or selling merchandise.

5.3 You understand and agree that:

5.3.1 In the event that Xiaomi suspects that the User has violated this Agreement, the license may be revoked, or other appropriate measures within the scope of this Agreement may be taken.

5.3.2 If the User publishes information upon the platform which may infringe upon any person's legal rights or violates this Agreement, the information will be deleted directly.

5.3.3 In the event of damage to a third party by a User who violates this Agreement, the User shall assume liability in their own name and understand that Xiaomi shall not be responsible for any loss or damage.

5.3.4 If the User violates the law or the terms of this Agreement and such violation leads to losses from the side of Xiaomi or a third party or fines from legal authorities, the User should compensate for the loss caused and/or the costs incurred, including reasonable lawyer fees, investigation and evidence collection costs.

6. Liability for breach of this Agreement

6.1 Xiaomi has the right to determine whether the User's behavior is in compliance with the provisions of this Agreement. If it believes that the User has violated the relevant laws and regulations, or the provisions of this Agreement and relevant rules, Xiaomi reserves the right to delete the illegal information, restrict, suspend, or terminate the User's use of Xiaomi Home cloud storage services, pursue the User's liability, and other processing measures that Xiaomi deems appropriate according to the severity of the User's violation.You shall bear full responsibility for causing any loss to Xiaomi (including but not limited to receiving any third party claims or penalties from any administrative department).

7. Service risks and disclaimers

7.1 Xiaomi assumes no responsibility for data loss or other losses caused by users' failure to back up their data before the expiration of their cloud storage package.

7.2 Xiaomi provides service support based on current technology.Xiaomi cannot guarantee that Xiaomi Home cloud storage services will be fully uninterrupted or error-free, that all of their defects will be corrected, or that they will be able to satisfy all user demands.Xiaomi shall not bear any liability arising therefrom.

7.3 Neither Xiaomi nor its Cooperators shall be liable for any losses caused by third parties, such as communication line failures, technical problems, network failures, computer terminal equipment failures, system instability, or as a consequence of force majeure.

7.4 Xiaomi Home cloud storage services, like most Internet software and services, may be subject to various security problems brought about by users, network connection quality, social environment, etc. For example, publishing personal information may result in real-life harassment. Other software products installed on the same device and websites visited which contain viruses and malware, such as Trojan horses, may carry security risks and influence the functioning of cloud storage services.To avoid damage and harassment, you are advised to be aware of the possible security risks and take the necessary measures to prevent them.

7.5 Note that in order to protect the development and autonomy of our company's business, Xiaomi reserves the right to modify or interrupt services at any time and without prior notice. Xiaomi shall not assume any responsibility toward the User or any third party for exercising the right mentioned above.

7.6 Unless otherwise specified by laws and regulations, Xiaomi will try its best to ensure that cloud storage services and the technology and information involved are safe, effective, accurate, and reliable. However, please understand that we cannot guarantee it in the cases when this service is restricted fully or in part by the current state of technology.

7.7 You shall bear the responsibility with respect to any physical harm, or incidental or indirect economic losses or damages (including but not limited to losses of profits, losses of data, business interruption damages, or other commercial damages or losses) resulting from the following situations:

7.7.1 You use or fail to use Xiaomi Home cloud storage services;

7.7.2 A third party uses this cloud storage service or changes the User's data without permission;

7.7.3 You perform actions which result in fees or losses while using Xiaomi Home cloud storage services;

7.7.4 You have a misunderstanding regarding this cloud storage service; or

7.7.5 Any other loss or damage related to Xiaomi Home cloud storage services caused by parties other than Xiaomi.

7.9 The User understands and agrees that Xiaomi will undertake commercially reasonable efforts to ensure the security of the User's data stored in Xiaomi Home cloud storage services, but that Xiaomi cannot provide a complete guarantee for this security.and Xiaomi shall not bear any liability therefor.

8. Intellectual property rights

8.1 Xiaomi is the intellectual property owner of this cloud storage service. Any copyright, trademarks, patent rights, trade secrets, and other intellectual property rights related to Xiaomi Home cloud storage services and all its related content (including but not limited to text, images, audio, video, charts, interface and layout design, relevant data, or electronic documents) belong to Xiaomi and are protected by local laws and regulations and corresponding international treaties.

8.2 You may not, as an individual or by authorizing a third party to do so, enforce, use, or transfer the intellectual property rights mentioned above for commercial or non-commercial purposes without the written consent of Xiaomi. Xiaomi reserves the right to take legal action against such conduct.

9. Use by minors

9.1 Minors under the age of 18 shall read this Agreement and use Xiaomi Home cloud storage services under the supervision of their legal guardian and with the guardian's consent.

9.2 Special tips for minors:

9.2.1 When using Xiaomi Home cloud storage services, minors should use the Internet within a reasonable range approved by their legal guardian, avoid developing Internet addiction, and develop healthy habits of consuming online content.

9.2.2 Minors must abide by the Chinese National Internet Behavior Convention for Teenagers:

(1) To use the Internet for learning and avoid destructive information;

(2) To be honest and friendly in communication, and avoid insulting or offending others;

(3) To enhance awareness of personal safety and avoid meeting face-to-face with netizens;

(4) To maintain network security and not to disrupt network order; and

(5) To maintain their physical and mental health and avoid developing Internet addiction.

10. Modification of this Agreement

10.1 Xiaomi has the right to amend the clauses of this Agreement if and when necessary. Once any clause of this Agreement is amended, the amended clause will be published on the relevant page. If you do not agree with the amendments made, you should stop using this Service. Your continued use of the Service will constitute your acceptance of any changes or modifications of the Agreement.If you do not agree with the amendments made, you should stop using this Service. 10.2 We may change or modify the paid services, payment standards and methods, service fees, and terms of service at any time.We will notify you about changes related to payments via email or other methods.

11. Applicable laws and dispute resolution

11.1 The validity, interpretation of terms, and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China.In the absence of relevant legal provisions, international business practices will be used as reference.

11.2 This Agreement is signed in Haidian district, Beijing.

11.3 Any dispute or controversy arising between you and Xiaomi should first be settled through friendly consultation. If consultation fails, either party may submit the dispute to the court in the jurisdiction where this Agreement was signed.

12. Miscellaneous

12.1 Xiaomi will notify users by email, text message, webpage announcement, or any other means that Xiaomi deems appropriate to inform users of changes to the Terms of Service, service changes, and/or other important matters.After Xiaomi notifies the User through any of the aforementioned methods, the User may submit an objection in writing within 3 days, after which they shall be regarded as having accepted the content of the notification.

12.2 Separate independent agreements (hereinafter referred to as "Independent Agreements") may appear when using Xiaomi Home cloud storage services. Read such agreements prior to using the related services.

12.3 The titles of each paragraph are written only for the convenience of reading and cannot be used as a basis of the interpretation of the Agreement.

12.4 If some provisions of this Agreement cannot be applied for any reason, all other provisions remain valid and are binding on both parties.
